Terms of Service

The terms governing your use of LumiQ Pay's payment services and platform.

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you ("Merchant", "you") and MaveriQ Technologies ("LumiQ Pay", "we", "us") governing your access to and use of the LumiQ Pay platform, APIs, dashboard and related services (the "Services"). By creating an account or using the Services, you agree to these Terms.

2. Eligibility & accounts

You must be a legally registered business or an individual authorised to transact, and provide accurate onboarding (KYC) information. You are responsible for safeguarding your API keys and credentials, and for all activity under your account.

3. The Services

  • We enable you to accept payments via M-PESA, cards, mobile money and bank transfers, and to make payouts where enabled.
  • We provide a dashboard, reporting, and developer APIs to manage transactions.
  • We may use third-party providers and financial institutions to deliver parts of the Services.

4. Fees & settlement

Transaction fees are as set out in your plan or commercial agreement. We deduct applicable fees before settling funds to your designated account on the agreed schedule. We may adjust fees with prior notice.

5. Your obligations

  • Use the Services only for lawful transactions and permitted business types.
  • Comply with applicable laws, card-scheme rules, and our acceptable-use and compliance policies.
  • Not engage in fraud, money laundering, or processing on behalf of undisclosed third parties.

6. Refunds, chargebacks & reserves

You are responsible for refunds and for chargebacks raised against your transactions. We may hold reserves or delay settlement where risk warrants, and may recover amounts owed from your balance or settlement funds.

7. Suspension & termination

We may suspend or terminate access for breach of these Terms, suspected fraud, regulatory requirement, or unacceptable risk. You may close your account at any time subject to settlement of outstanding obligations.

8. Liability

The Services are provided on a commercially reasonable basis. To the extent permitted by law, our aggregate liability is limited as set out in your commercial agreement, and we are not liable for indirect or consequential losses.

9. Changes & governing law

We may update these Terms with notice. These Terms are governed by the laws of the Republic of Kenya, and disputes are subject to the jurisdiction of its courts.
